국가통합교통체계효율화법 시행령 제77조(지능형교통체계 표준인증 및 품질인증 등)

① 법 제83조제1항에 따라 표준인증 또는 품질인증을 받으려는 자는 국토교통부령으로 정하는 신청서를 법 제83조제2항에 따른 표준인증기관 및 품질인증기관(이하 "표준인증기관 및 품질인증기관"이라 한다)에 제출하여야 한다. <개정 2013.3.23>

(1) A어 person퍼슨 who후 intends인텐즈 to투 obtain어브테인 standards스탠더즈 certification서터^f퍼케이션 or오 quality콸러티 certification서터^f퍼케이션 pursuant퍼수언트 to투 Article아터클 83 (1) of어^v브 the^ð디 Act액트 shall섈 submit서브밋 an앤 application애플러케이션 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 to투 the^ð더 standards스탠더즈 certification서터^f퍼케이션 institution인스티투션 and앤드 quality콸러티 certification서터^f퍼케이션 institution인스티투션 under언더 Article아터클 83 (2) of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "standards스탠더즈 certification서터^f퍼케이션 institution인스티투션 and앤드 quality콸러티 certification서터^f퍼케이션 institution").인스티투션

② 표준인증기관 및 품질인증기관은 인증기준에 따라 지능형교통체계 관련 장비ㆍ제품 및 서비스 등을 평가ㆍ심사한 후 인증기준에 적합하다고 인정하는 경우에는 국토교통부령으로 정하는 인증서를 발급하여야 한다. <개정 2013.3.23>

(2) After애^f프터 evaluating이^v밸류에이팅 and앤드 examining이그재미닝 equipment,이큅먼트 products,프^r라덕츠 and앤드 services,서^v버시즈 etc.엣세터^r러 related^r릴레이티드 to투 intelligent인텔러전트 transport트^r랜스포트 systems시스텀즈 according어코딩 to투 certification서터^f퍼케이션 criteria,크^r라이티^r리아 the^ð더 standards스탠더즈 certification서터^f퍼케이션 institution인스티투션 and앤드 quality콸러티 certification서터^f퍼케이션 institution인스티투션 shall섈 issue이슈 a어 certificate서티^f피컷 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 if이^f프 they^ð데이 recognize^r레커그나이즈 that^ð댓 the^ð더 criteria크^r라이티^r리아 are아 met.멧

③ 표준인증기관 및 품질인증기관은 제2항에 따른 평가ㆍ심사결과 인증기준에 부적합한 경우에는 지체 없이 그 사유를 구체적으로 밝혀 신청자에게 통지하여야 한다.

(3) Where,웨어 as애즈 a어 result^r리절트 of어^v브 the^ð디 evaluation이^v밸류에이션 and앤드 examination이그재머네이션 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 certification서터^f퍼케이션 criteria크^r라이티^r리아 are아 not낫 met,멧 the^ð더 standards스탠더즈 certification서터^f퍼케이션 institution인스티투션 and앤드 quality콸러티 certification서터^f퍼케이션 institution인스티투션 shall섈 notify노우터^f파이 the^ð디 applicant애플리컨트 without위^ð다웃 delay,딜레이 specifying스페서^f파이잉 the^ð더 reasons.^r리즌즈

④ 국토교통부장관은 표준인증 또는 품질인증의 대상이 되는 장비ㆍ제품의 품목 및 서비스 분야를 지정하였을 때에는 그 내용을 관보 및 인터넷 홈페이지에 공고하여야 한다. <개정 2013.3.23>

(4) Upon어판 designating데지그네이팅 the^ð디 items아이텀즈 of어^v브 equipment이큅먼트 and앤드 products프^r라덕츠 and앤드 fields^f필즈 of어^v브 services서^v버시즈 subject서브젝트 to투 standards스탠더즈 certification서터^f퍼케이션 or오 quality콸러티 certification,서터^f퍼케이션 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 shall섈 publicly퍼블리클리 announce어나운스 them^ð뎀 in인 the^ð디 Official어^f피실 Gazette거젯 and앤드 on안 the^ð더 website.웨브사잇

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 표준인증 및 품질인증의 세부절차ㆍ방법 등 표준인증 및 품질인증에 필요한 사항은 국토교통부장관이 관계 기관의 장과 협의하여 정하고 이를 고시한다. <개정 2013.3.23>

⑥ 국토교통부장관은 표준인증기관 및 품질인증기관이 그 업무를 수행하는 데에 필요한 경비를 예산의 범위에서 지원할 수 있다. <개정 2013.3.23>
