국가재정법 제43조의2(예산의 재배정)

① 각 중앙관서의 장은 「국고금 관리법」 제22조제1항에 따른 재무관으로 하여금 지출원인행위를 하게 할 때에는 제43조에 따라 배정된 세출예산의 범위 안에서 재무관별로 세출예산재배정계획서를 작성하고 이에 따라 세출예산을 재배정(기획예산처장관이 각 중앙관서의 장에게 배정한 예산을 각 중앙관서의 장이 재무관별로 다시 배정하는 것을 말한다. 이하 같다)하여야 한다. <개정 2025.10.1>

② 각 중앙관서의 장은 예산집행에 필요하다고 인정할 때에는 제1항에 따라 작성한 세출예산재배정계획서를 변경할 수 있고 이에 따라 세출예산을 재배정하여야 한다.

③ 각 중앙관서의 장은 제1항 및 제2항에 따라 세출예산을 재배정한 때에는 이를 「국고금 관리법」 제22조제1항에 따른 지출관, 재정경제부장관과 기획예산처장관에게 각각 통지하여야 한다. <개정 2025.10.1>

④ 각 중앙관서의 장은 제1항 및 제2항에 따라 세출예산을 재배정하려는 경우 대통령령으로 정하는 바에 따라 이를 「한국재정정보원법」에 따른 한국재정정보원으로 하여금 대행하게 할 수 있다.
