국가재정법 제39조(대규모 개발사업예산의 편성)

①각 중앙관서의 장은 대통령령으로 정하는 대규모 개발사업에 대하여는 타당성조사 및 기본설계비ㆍ실시설계비ㆍ보상비(댐수몰지역에 대하여 보상하는 경우와 공사완료 후 존속하는 어업권 또는 양식업권의 피해에 대하여 보상하는 경우는 제외한다)와 공사비의 순서에 따라 그 중 하나의 단계에 소요되는 경비의 전부 또는 일부를 해당 연도의 예산으로 요구하여야 한다. 다만, 부분완공 후 사용이 가능한 경우 등 사업의 효율적인 추진을 위하여 기획예산처장관이 불가피하다고 인정하는 사업에 대하여는 2단계 이상의 예산을 동시에 요구할 수 있다. <개정 2008.2.29, 2019.8.27, 2020.6.9, 2025.10.1>

②기획예산처장관은 제1항에 따른 대규모 개발사업에 대하여는 같은 항에 따른 요구에 따라 단계별로 해당 연도에 필요한 예산안을 편성하여야 한다. 이 경우 다음 각 호의 어느 하나에 해당하는 사업으로서 전체공정에 대한 실시설계가 완료되고 총사업비가 확정된 경우에는 그 사업이 지연되지 아니하도록 계속비로 예산안을 편성하여야 한다. <개정 2008.2.29, 2012.3.21, 2025.10.1>

③ 기획예산처장관은 제2항 후단에도 불구하고 재정여건, 사업성격, 사업기간 및 규모 등을 고려하여 필요하다고 인정하는 대규모 개발사업은 계속비로 예산안을 편성하지 아니할 수 있으며 이에 대한 기준, 절차 등 구체적 사항은 대통령령으로 정한다. <신설 2012.3.21, 2025.10.1>
