국가유산수리 등에 관한 법률 제25조의2(하도급계약의 적정성 심사 등)

① 발주자는 다음 각 호의 어느 하나에 해당하는 경우에는 하수급인의 국가유산수리 능력 또는 하도급계약 내용의 적정성을 심사할 수 있다. <개정 2023.8.8>

② 발주자는 제1항에 따른 심사 결과 하수급인의 국가유산수리 능력 또는 하도급계약 내용이 적정하지 아니하다고 인정되는 경우에는 그 사유를 분명하게 밝혀 수급인에게 하수급인 또는 하도급계약 내용의 변경을 요구할 수 있다. <개정 2023.8.8>

③ 발주자는 수급인이 정당한 이유 없이 제2항의 요구에 따르지 아니하여 국가유산수리 결과에 중대한 영향을 미칠 우려가 있는 경우에는 해당 국가유산수리의 도급계약을 해지할 수 있다. <개정 2023.8.8>

④ 제1항부터 제3항까지에 따른 하도급계약의 적정성 심사기준 및 심사방법, 하수급인 또는 하도급계약 내용의 변경요구 절차, 그 밖에 필요한 사항은 대통령령으로 정한다.
