국가보위에 관한 특별조치법 제5조제4항에 의한 동원대상지역 내의 토지의 수용ㆍ사용에 관한 특별조치령에 의하여 수용ㆍ사용된 토지의 정리에 관한 특별조치법 제5조((무상 사용 중인 국·공유토지의 처리))

① 군(軍)은 이 법 시행 당시 특별조치령에 따라 무상으로 사용 중인 철도사업특별회계 및 통신사업특별회계 소관 국유토지와 공유토지를 군사상의 필요에 따라 점유하는 기간에는 무상(無償)으로 사용한다.

② 국방부장관은 제1항에 따른 토지를 사용할 필요가 없게 되었을 때에는 지체 없이 그 사용을 해제하고, 3개월 이내에 반환절차를 마쳐야 한다.
