국가배상법 제12조(배상신청)

① 이 법에 따라 배상금을 지급받으려는 자는 그 주소지ㆍ소재지 또는 배상원인 발생지를 관할하는 지구심의회에 배상신청을 하여야 한다.

② 손해배상의 원인을 발생하게 한 공무원의 소속 기관의 장은 피해자나 유족을 위하여 제1항의 신청을 권장하여야 한다.

③ 심의회의 위원장은 배상신청이 부적법하지만 보정(補正)할 수 있다고 인정하는 경우에는 상당한 기간을 정하여 보정을 요구하여야 한다.

④ 제3항에 따른 보정을 하였을 때에는 처음부터 적법하게 배상신청을 한 것으로 본다.

⑤ 제3항에 따른 보정기간은 제13조제1항에 따른 배상결정 기간에 산입하지 아니한다.
