국가공무원법 제31조(경쟁시험 합격자의 우선임용 및 결원 보충의 조정)

① 임용권자나 임용제청권자는 결원을 보충할 때 공개경쟁 채용시험 합격자와 공개경쟁 승진시험 합격자를 우선하여 임용하거나 임용제청하여야 한다.

② 중앙인사관장기관의 장은 각급 기관의 5급 이상 공무원(제4조제2항에 따라 같은 조 제1항의 계급 구분을 적용하지 아니하는 공무원 중 5급 이상에 상당하는 공무원을 포함한다. 이하 같다)의 결원을 보충할 때 공개경쟁 채용시험 합격자, 공개경쟁 승진시험 합격자 및 일반 승진시험 합격자의 보충임용이 적절한 균형을 유지할 수 있도록 조정하고 규제하여야 한다.
