State Public Officials Act, Article 28 (New Recruitment)

① 공무원은 공개경쟁 채용시험으로 채용한다. <개정 2011.5.23>

(1) Public퍼블릭 officials어^f피실즈 shall섈 be비 recruited^r리크^r루티드 through^θ쓰^r루 open오우픈 competitive컴페터티^v브 recruitment^r러크^r룻먼트 examinations.이그재머네이션즈

② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 경력 등 응시요건을 정하여 같은 사유에 해당하는 다수인을 대상으로 경쟁의 방법으로 채용하는 시험(이하 "경력경쟁채용시험"이라 한다)으로 공무원을 채용할 수 있다. 다만, 제1호, 제3호부터 제5호까지, 제7호 및 제11호의 어느 하나에 해당하는 경우 중 다수인을 대상으로 시험을 실시하는 것이 적당하지 아니하여 대통령령등으로 정하는 경우에는 다수인을 대상으로 하지 아니한 시험으로 공무원을 채용할 수 있다. <개정 2010.3.22, 2011.5.23, 2012.10.22, 2012.12.11, 2013.3.23, 2014.11.19, 2015.5.18, 2018.3.20, 2022.12.27, 2024.12.31>

1. 제70조제1항제3호의 사유로 퇴직하거나 제71조제1항제1호의 휴직 기간 만료로 퇴직한 경력직공무원을 퇴직한 날부터 3년(「공무원 재해보상법」에 따른 공무상 부상 또는 질병으로 인한 휴직의 경우에는 5년) 이내에 퇴직 시에 재직한 직급(고위공무원단에 속하는 공무원은 퇴직 시에 재직한 직위와 곤란성과 책임도가 유사한 직위를 말한다. 이하 이 호에서 같다)의 경력직공무원으로 재임용하는 경우 또는 경력직공무원으로 재직하던 중 특수경력직공무원이나 다른 종류의 경력직공무원이 되기 위하여 퇴직한 자를 퇴직 시에 재직한 직급의 경력직공무원으로 재임용하는 경우
