지식재산처장이 「발명진흥법」 제10조제4항에 따라 국가직무발명특허권등을 포기하려는 경우에는 발명기관의 장과 관계기관의 장의 의견, 국가직무발명특허권등 실시 이력, 기술평가 결과 및 국가직무발명특허권등의 존속기간 등을 고려하여야 한다. <개정 2024.11.12, 2025.10.1>
