국가공무원 등 직무발명의 처분ㆍ관리 및 보상 등에 관한 규정 제17조(처분보상금)

① 지식재산처장은 국가직무발명특허권등을 유상으로 처분한 경우에는 그 처분수입금의 100분의 50 이상의 범위에서 예산 등을 고려하여 지식재산처장이 정하여 고시하는 바에 따라 처분보상금을 발명자에게 지급해야 한다. <개정 2025.10.1>

② 발명기관의 장은 특허등 출원 중인 직무발명에 대하여 특허등을 받을 수 있는 권리를 유상으로 처분한 경우에는 그 처분수입금의 100분의 50 이상의 범위에서 예산 등을 고려하여 처분보상금을 발명자에게 지급해야 한다.
