1. 국가직무발명특허권등의 내용상 그 실시에 특정인의 기술이나 설비가 필요하여 경쟁입찰을 할 수 없는 경우

6. 「공공기관의 운영에 관한 법률」 제4조에 따라 지정된 공공기관 중 정부가 납입자본금의 100분의 50 이상을 출자한 공공기관의 보호ㆍ육성을 위하여 그 공공기관에 필요한 국가직무발명특허권등을 처분하는 경우. 다만, 「한국산업은행법」에 따른 한국산업은행, 「중소기업은행법」에 따른 중소기업은행, 「한국수출입은행법」에 따른 한국수출입은행 및 「은행법」 제2조 및 제5조에 따른 은행에 대해서는 적용하지 아니한다.
