교육공무원법 제40조(특별연수)

① 국가나 지방자치단체는 특별연수계획을 수립하여 교육공무원을 국내외의 교육기관 또는 연구기관에서 일정 기간 연수를 받게 할 수 있다.

② 국가나 지방자치단체는 예산의 범위에서 제1항에 따른 특별연수 경비를 지급할 수 있다.

③ 교육부장관은 제1항에 따라 특별연수를 받고 있는 교육공무원이 연수 목적을 성실하게 수행할 수 있도록 지도ㆍ감독하여야 하며, 이를 위하여 필요한 사항은 대통령령으로 정한다. <개정 2013.3.23>

④ 제1항에 따라 특별연수를 받은 교육공무원에게는 6년의 범위에서 대통령령으로 정하는 바에 따라 일정 기간 복무 의무를 부과할 수 있다.

⑤ 교육부장관은 제1항에 따라 특별연수를 받고 있거나 받은 교육공무원이 다음 각 호의 어느 하나에 해당하는 경우에 본인에게 그 특별연수 경비의 전부 또는 일부를 반납할 것을 명할 수 있고, 본인이 반납하지 아니할 경우 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)에게 보증채무의 이행을 청구할 수 있으며, 반납하지 아니하면 그 특별연수 경비의 재원(財源)에 따라 국세 체납처분 또는 지방세 체납처분의 예에 따라 징수할 수 있다. 이 경우 반납에 필요한 사항은 대통령령으로 정한다. <개정 2013.3.23, 2022.10.18>
