교원 지위 향상을 위한 교섭ㆍ협의에 관한 규정 제4조(교섭·협의절차등)

①교육회는 교섭ㆍ협의요구를 하고자 하는 때에는 교섭ㆍ협의 개시예정일 20일전까지 교섭ㆍ협의내용을 상대방에게 서면으로 통보하여야 한다. 다만, 긴급한 사안이 있는 때에는 7일전까지 통보할 수 있다.

②제1항의 규정에 의한 교섭ㆍ협의요구가 있는 때에는 당해 당사자는 그 소속 직원중에서 지명한 자로 하여금 교섭ㆍ협의내용의 범위, 교섭ㆍ협의대표, 교섭ㆍ협의의 일시 및 장소 기타 교섭ㆍ협의에 필요한 사항에 관하여 미리 실무협의를 하도록 하고 그 결과를 서면으로 작성하게 하여야 한다.

③교섭ㆍ협의대표는 당사자가 각각 지명하되, 쌍방이 같은 수로 한다.

④당사자는 각각 필요하다고 인정하는 때에는 교섭ㆍ협의내용과 관련이 있는 자 또는 기관ㆍ단체등의 의견을 들을 수 있다.

⑤당사자는 평화적 교섭ㆍ협의에 지장을 주는 행위를 하여서는 아니된다.

⑥교섭ㆍ협의에서 합의한 사항에 관하여는 교섭ㆍ협의대표 전원이 서명한 합의서 2부를 작성하여 당사자가 각각 1부씩 보관한다.
