교과용 도서에 관한 규정 제33조(검정도서와 인정도서의 가격 등)

① 검정도서와 인정도서의 가격은 저작자와 약정한 출판사가 정한다.

② 제1항에도 불구하고 교육부장관은 다음 각 호의 사유로 검정도서와 인정도서의 가격이 부당하게 결정될 우려가 있거나 그 가격이 결정된 이후 도서개발에 투입된 비용(이하 "고정비"라 한다)을 출판사가 전부 회수하였음에도 이를 가격에 반영하지 아니하는 경우에는 심의회를 거쳐 그 가격의 조정을 명할 수 있다. <개정 2014.2.18>

③ 제2항에 따라 가격 조정 명령을 하는 경우 그 조정 금액은 재료비, 인쇄ㆍ제조비 또는 제작비(교과용 도서를 개발하거나 생산하기 위하여 투입하는 비용으로서 인쇄ㆍ제본비 또는 복제비, 고정비 및 고정비 이자를 합한 금액을 말한다), 일반관리비, 그 밖의 경비, 출판사 이윤, 저작자 인세, 도서개발 지원금, 공급수수료 등을 고려하여 산정하되, 항목별 세부사항은 교육부장관이 정하여 고시한다. <신설 2014.2.18, 2023.10.24, 2025.11.25>

④ 제2항에 따른 가격 조정 명령에 대하여 이의가 있는 자는 그 명령을 통지받은 날부터 1개월 이내에 별지 제2호서식에 따라 교육부장관에게 이의신청을 할 수 있다. <신설 2014.2.18>
