광업법 제10조(광업권의 성질)

①광업권은 물권으로 하고, 이 법에서 따로 정한 경우 외에는 부동산에 관하여 「민법」과 그 밖의 법령에서 정하는 사항을 준용한다.

②광업권은 광업의 합리적 개발이나 다른 공익과의 조절을 위하여 이 법이 규정하는 바에 따라 제한할 수 있다.
