광산안전법 제3조(처분 등의 효력)

① 이 법(이 법에 따른 명령을 포함한다. 이하 이 조에서 같다)에 따른 처분과 광업권자(鑛業權者)나 조광권자(租鑛權者)가 이 법에 따라 행한 절차 또는 그 밖의 행위는 광업권자나 조광권자의 승계인에 대하여도 효력을 가진다.

② 조광권을 설정하거나 조광구(租鑛區)가 증가한 경우에는 이 법에 따른 처분과 채굴권자가 이 법에 따라 행한 절차 또는 그 밖의 행위는 조광권의 범위에서 조광권자에 대하여도 효력을 가진다.

③ 조광권이 소멸하거나 조광구가 감소한 경우에는 이 법에 따른 처분과 조광권자가 이 법에 따라 행한 절차 또는 그 밖의 행위는 채굴권의 범위에서 채굴권자에 대하여도 효력을 가진다. 다만, 채굴권의 소멸로 인하여 조광권이 소멸된 경우에는 그러하지 아니하다.
