광산안전법 제13조(광산안전관리직원)

① 광업권자나 조광권자는 산업통상부령으로 정하는 바에 따라 광산안전관리직원을 선임하여야 한다. <개정 2013.3.23, 2016.1.6, 2025.10.1>

② 산업통상부장관은 광산안전상 필요하다고 인정할 때에는 광업권자나 조광권자에게 광산안전관리직원의 해임을 명할 수 있다. <개정 2013.3.23, 2016.1.6, 2025.10.1>

③ 광업권자나 조광권자는 광산안전관리직원을 선임하거나 해임하였을 때에는 산업통상부령으로 정하는 바에 따라 그 사실을 산업통상부장관에게 신고하여야 한다. <개정 2013.3.23, 2016.1.6, 2025.10.1>

④ 광산안전관리직원은 산업통상부령으로 정하는 바에 따라 광산안전에 관한 사항을 관리 및 준수하여야 한다. <개정 2013.3.23, 2016.1.6, 2025.10.1>

⑤ 광업권자나 조광권자는 광산안전관리직원이 여행, 질병, 그 밖의 사고로 인하여 직무를 수행할 수 없는 경우 그 직무의 계속적인 수행을 위하여 산업통상부령으로 정하는 바에 따라 미리 광산안전관리직원의 대리자를 선임하고 이를 산업통상부장관에게 신고하여야 한다. <개정 2013.3.23, 2016.1.6, 2025.10.1>

⑥ 제3항 또는 제5항에 따른 신고가 신고서의 기재사항 및 첨부서류에 흠이 없고, 법령 등에 규정된 형식상의 요건을 충족하는 경우에는 신고서가 접수기관에 도달된 때에 신고된 것으로 본다. <신설 2022.2.3>

⑦ 제5항에 따른 대리자가 광산안전관리직원의 직무를 수행하는 경우 이 법 및 이 법에 따른 명령의 규정을 적용할 때에는 그 대리자를 광산안전관리직원으로 본다. <개정 2016.1.6, 2022.2.3>

⑧ 광산안전관리직원은 「국가기술자격법」에 따라 일정한 자격을 가진 사람으로서 산업통상부령으로 정하는 사람이어야 한다. <개정 2013.3.23, 2016.1.6, 2022.2.3, 2025.10.1>

⑨ 광산안전관리직원은 둘 이상의 광산의 광산안전관리직원을 겸할 수 없다. 다만, 특별한 사유로 인하여 산업통상부장관의 승인을 받았을 때에는 겸직할 수 있다. <개정 2013.3.23, 2016.1.6, 2022.2.3, 2025.10.1>
