관세법 시행령 제266조의5(관세범칙조사심의위원회의 운영)

① 관세범칙조사심의위원회의 위원장은 법 제284조의2제1항 각 호의 사항에 관한 심의가 필요한 경우 회의를 소집하고 그 의장이 된다.

② 관세범칙조사심의위원회의 회의는 위원장을 포함한 재적위원 과반수의 출석으로 개의하고, 출석위원 과반수의 찬성으로 의결한다.

(2) A어 meeting미팅 of어^v브 the^ð더 Customs커스텀즈 Offense어^f펜스 Investigation인^v베스터게이션 Review^r리^v뷰 Committee커미티 shall섈 be비 convened컨^v빈드 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð디 incumbent인컴번트 members멤버즈 including인클루딩 the^ð더 chairperson,체어퍼슨 and앤드 decisions디시전즈 shall섈 be비 made메이드 by바이 the^ð디 affirmative어^f퍼머티^v브 vote^v보우트 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 present.프^r레전트

③ 관세범칙조사심의위원회의 사무를 처리하기 위하여 간사 1명을 두고, 간사는 위원장이 관세청 소속 공무원 중에서 지명한다.

④ 관세범칙조사심의위원회의 위원장은 회의를 개최한 때에는 심의내용, 결정사항 등이 포함된 회의록을 작성하여 보관해야 한다.

(4) When웬 the^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Customs커스텀즈 Offense어^f펜스 Investigation인^v베스터게이션 Review^r리^v뷰 Committee커미티 holds호울즈 a어 meeting,미팅 the^ð더 chairperson체어퍼슨 shall섈 prepare프^r리페어 and앤드 keep킵 minutes미닛츠 including인클루딩 the^ð더 content칸텐트 of어^v브 deliberation,딜리버^r레이션 decisions,디시전즈 and앤드 the^ð더 like.라이크

⑤ 관세범칙조사심의위원회의 위원장은 회의에서 심의ㆍ의결한 사항을 관세청장에게 통보해야 한다.

(5) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Customs커스텀즈 Offense어^f펜스 Investigation인^v베스터게이션 Review^r리^v뷰 Committee커미티 shall섈 notify노우터^f파이 the^ð더 Commissioner커미셔너 of어^v브 the^ð더 Korea코^r리아 Customs커스텀즈 Service서^v비스 of어^v브 matters매터즈 deliberated딜리버^r레이티드 and앤드 decided디사이디드 at앳 the^ð더 meeting.미팅

⑥ 관세범칙조사심의위원회의 회의와 회의록은 공개하지 않는다. 다만, 위원장이 필요하다고 인정하는 경우에는 공개할 수 있다.

(6) Meetings미팅즈 and앤드 minutes미닛츠 of어^v브 the^ð더 Customs커스텀즈 Offense어^f펜스 Investigation인^v베스터게이션 Review^r리^v뷰 Committee커미티 shall섈 not낫 be비 open오우픈 to투 the^ð더 public.퍼블릭 However,하우에^v버 they^ð데이 may메이 be비 open오우픈 to투 the^ð더 public퍼블릭 where웨어 the^ð더 chairperson체어퍼슨 recognizes^r레커그나이지즈 it잇 as애즈 necessary.네서세^r리

⑦ 관세범칙조사심의위원회는 의안에 관하여 필요하다고 인정되는 때에는 공무원 등 관계자에게 출석을 요청하여 의견을 들을 수 있고 관련 기관에 필요한 자료를 요청할 수 있다.

⑧ 제1항부터 제7항까지에서 규정한 사항 외에 위원회의 운영에 필요한 사항은 관세청장이 정한다.
