관세법 시행령 제25조(동종ㆍ동질물품의 범위)

① 법 제31조제1항 각 호 외의 부분에서 "동종ㆍ동질물품"이란 해당 수입물품의 생산국에서 생산된 것으로서 물리적 특성, 품질 및 소비자 등의 평판을 포함한 모든 면에서 동일한 물품(외양에 경미한 차이가 있을 뿐 그 밖의 모든 면에서 동일한 물품을 포함한다)을 말한다. <개정 2020.10.7>

② 법 제31조제1항제1호에서 "선적일"은 수입물품을 수출국에서 우리나라로 운송하기 위하여 선적하는 날로 하며, 선하증권, 송품장 등으로 확인한다. 다만, 선적일의 확인이 곤란한 경우로서 해당 물품의 선적국 및 운송수단이 동종ㆍ동질물품의 선적국 및 운송수단과 동일한 경우에는 같은 호에 따른 "선적일"을 "입항일"로, "선적"을 "입항"으로 본다. <신설 2020.10.7>

③ 법 제31조제1항제1호에서 "해당 물품의 선적일을 전후하여 가격에 영향을 미치는 시장조건이나 상관행에 변동이 없는 기간"은 해당 물품의 선적일 전 60일과 선적일 후 60일을 합한 기간으로 한다. 다만, 농림축산물 등 계절에 따라 가격의 차이가 심한 물품의 경우에는 선적일 전 30일과 선적일 후 30일을 합한 기간으로 한다. <신설 2020.10.7>

④ 법 제31조제1항제2호에 따른 가격차이의 조정은 다음 각 호의 구분에 따른 방법으로 한다. <신설 2020.10.7>

⑤ 법 제31조제3항을 적용할 때 해당 물품의 생산자가 생산한 동종ㆍ동질물품은 다른 생산자가 생산한 동종ㆍ동질물품보다 우선하여 적용한다. <신설 2020.10.7>
