Public Service Ethics Act, Article 18-4 (Restrictions on Acts of Retired Public Officials, etc.)
(1) A retired public official and an officer or employee of a public service-related organization (hereinafter referred to as a "retired public official") shall not, for his or her own or a third party's benefit, make an improper solicitation or brokerage that impairs the fair performance of duties, such as causing a public official, officer, or employee (hereinafter referred to as an "incumbent") of the institution to which he or she belonged before retirement to violate statutes or abuse position or authority.
(2) An incumbent who receives a solicitation or brokerage related to duties from a retired public official shall report it to the head of the institution to which he or she belongs.
(3) Anyone who learns that a retired public official has solicited or brokered with an incumbent may report it to the head of the institution concerned.
(4) The head of the institution to which the incumbent belongs shall determine whether matters reported pursuant to paragraph (2) or (3) constitute improper solicitation or brokerage under paragraph (1), and shall notify an investigative agency where he or she deems investigation necessary. In such cases, the head of the institution shall notify the competent Public Service Ethics Committee of the reported matters and the fact of notifying the investigative agency.
(5) No one may disclose to others, make public, or report the personal particulars of a reporter under paragraphs (2) and (3) or facts from which the person can be inferred to be the reporter; provided that this shall not apply where the reporter has consented.
(6) No one may take disadvantageous measures (meaning disadvantageous measures under Article 2 subparagraph 6 of the Public Interest Whistleblower Protection Act; hereinafter the same shall apply) against a reporter on account of the report, and a reporter who has suffered disadvantageous measures on account of the report may apply to the head of the institution that received the report for restoration to the original state or other necessary measures (hereinafter referred to as "protective measures"); provided that this shall not apply in the case of a false report.
(7) The head of an institution who receives an application for protective measures shall investigate whether the reporter has suffered disadvantageous measures on account of the report, and shall take protective measures where it is found as a result of the investigation that the reporter has suffered disadvantageous measures on account of the report.
(8) Where the head of an institution deems that a reporter's report has contributed to establishing public service ethics, the head may recommend or confer an award on the reporter pursuant to provisions such as the Award and Decoration Act, or pay a reward within the budget.
