① 공개대상자등은 다음 각 호의 기간 동안 공개대상자등 또는 그 이해관계자가 백지신탁한 주식이나 보유하고 있는 주식과 관련하여 해당 주식을 발행한 기업의 경영 또는 재산상 권리에 영향을 미칠 수 있는 직무에 결재, 지시, 의견표명 등의 방법을 통하여 관여해서는 아니 된다. <개정 2020.12.22>

② 공개대상자등은 제1항에 따라 직무를 회피하기 위하여 필요한 경우에는 해당 직무를 다른 사람으로 하여금 처리하게 하는 등의 조치를 하여야 한다.

③ 제1항에도 불구하고 공개대상자등은 법령에서 해당 직무를 직접 수행하도록 규정하고 있는 경우 등 직무회피가 불가능한 경우에는 백지신탁한 주식 또는 보유하고 있는 주식과 관련한 직무에 관여할 수 있다.

④ 제3항에 따라 공개대상자등이 백지신탁한 주식 또는 보유하고 있는 주식과 관련한 직무에 관여한 경우에는 매 분기 동안 해당 주식과 관련한 직무에 직접적 또는 간접적으로 관여한 내역을 매 분기 말일부터 10일 이내에 관할 공직자윤리위원회에 신고하여야 하며, 관할 공직자윤리위원회는 그 신고사항을 관보 또는 공보에 게재하여야 한다.
