공적자금관리 특별법 시행령 제5조의3(관련 기관에의 보고요구 등)

① 위원회는 법 제11조제1호에 따라 관련 기관에 대하여 보고 또는 자료ㆍ서류 등의 제출을 요구하는 경우에는 그 내용과 보고시기 또는 제출기한을 구체적으로 밝힌 서면으로 통지하여야 한다.

② 위원회는 법 제11조제2호에 따라 이해관계인ㆍ참고인 또는 관계 공무원의 출석 및 의견제출을 요구하는 경우에는 회의개최일 7일 전까지 서면으로 통지하여야 한다.

③ 제2항에 따라 통지를 받은 이해관계인ㆍ참고인 또는 관계 공무원은 회의에 출석하여 의견을 진술하거나 회의개최일 전날까지 서면으로 의견을 제출할 수 있다.

④ 위원회는 법 제11조제3호에 따라 관계 기관에 대한 실지조사를 하려는 경우에는 관계 기관에 대하여 조사목적ㆍ조사일시ㆍ조사장소 및 조사자의 인적사항 등을 해당 관계 기관에 미리 서면으로 통지하여야 한다. 다만, 긴급하거나 조사목적을 해칠 우려가 있는 경우에는 그러하지 아니하다.

⑤ 제4항에 따라 관계 기관에 대한 실지조사를 하는 사람은 그 권한을 표시하는 증표를 지니고 관계인에게 내보여야 한다.
