공장 및 광업재단 저당법 제47조(변경등기와 공장재단 구성물의 멸실 등)

① 공장재단의 구성물로서 등기된 것이 멸실하거나 재단에 속하지 아니하게 되어 변경등기 신청을 한 경우 등기관은 그 물건의 등기기록 중 해당 구에 그 사실을 기록하고, 제32조 및 제35조의 기록 사항을 말소하여야 한다. <개정 2012.2.10>

② 제1항에 따라 기록하여야 할 사항이 다른 등기소의 관할에 속하는 경우에는 그것이 멸실한 사실 또는 재단에 속하지 아니하게 된 사실을 지체 없이 그 등기소에 통지하여야 한다. <개정 2012.2.10>

③ 제2항의 통지를 받은 등기소는 제1항에 따른 기록 및 말소를 하여야 한다. <개정 2012.2.10>

④ 공장재단에 속하는 지식재산권이 소멸하거나 재단에 속하지 아니하게 된 경우에는 제1항부터 제3항까지의 규정을 준용한다. 이 경우 제2항에 따른 통지는 지식재산처에 하여야 한다. <개정 2011.5.19, 2025.10.1>
