공장 및 광업재단 저당법 제32조(소유권보존등기의 신청)

① 공장재단에 관한 소유권보존등기 신청을 받으면 그 공장재단의 구성물로 예정된 것으로서 등기가 된 것에 관하여 등기관은 직권으로 그 등기기록 중 해당 구(區)에 공장재단에 속하게 될 것으로서 그 재단에 관하여 소유권보존등기가 신청되었다는 사실, 신청서의 접수연월일과 접수번호를 기록하여야 한다. <개정 2012.2.10>

② 제1항에 따라 기록하여야 할 사항이 다른 등기소의 관할에 속할 때에는 지체 없이 그 등기소에 그 사항을 통지하여야 한다. <개정 2012.2.10>

③ 제2항에 따른 통지를 받은 등기소는 제1항에 따른 기록을 하고 그 등기사항증명서를 제2항에 따라 통지한 등기소에 송부하여야 한다. 이 경우 그 등기사항증명서에는 말소에 관계되는 사항은 기록하지 아니한다. <개정 2012.2.10>

④ 지식재산권이 공장재단에 속하는 경우에는 제1항부터 제3항까지의 규정을 준용한다. 다만, 제2항에 따른 통지는 지식재산처에 하여야 한다. <개정 2011.5.19, 2025.10.1>
