공무원 후생복지에 관한 규정 제3조(적용범위)

① 이 영에 따른 후생복지제도는 행정부 소속 국가공무원에 대하여 적용한다. <개정 2013.6.21>

② 제1항에도 불구하고 운영기관의 장은 인사혁신처장이 정하는 범위에서 다음 각 호의 어느 하나에 해당하는 사람에 대하여 제6조부터 제12조까지에 해당하는 사항의 적용을 배제하거나 제한할 수 있다. <개정 2013.6.21, 2014.11.19>

③ 제1항에도 불구하고 지방자치단체에 근무하는 국가공무원의 후생복지제도에 대해서는 해당 지방자치단체의 후생복지에 관한 조례를 적용한다. <신설 2020.3.10>

④ 운영기관의 장은 인사혁신처장이 정하는 기준의 범위 안에서 그 기관에 근무중인 자로서 공무원이 아닌 자에 대하여도 공무원에 준하여 후생복지제도를 적용할 수 있다. <개정 2008.2.29, 2013.3.23, 2014.11.19, 2020.3.10>
