공무원 재해보상법 제46조의2(건강안전관리체제 등)

① 국가기관의 장(국회는 국회사무총장, 법원은 법원행정처장, 헌법재판소는 헌법재판소사무처장, 중앙선거관리위원회는 중앙선거관리위원회사무총장, 정부는 각 중앙행정기관의 장을 말하고, 그 밖에 대통령령으로 정하는 국가기관의 장을 포함한다. 이하 같다), 지방자치단체의 장 및 교육감은 해당 기관(소속 기관 등 그 소관에 속하는 사무를 수행하는 각급 기관을 포함한다. 이하 같다)의 재해예방 업무를 총괄하는 건강안전책임관을 소속 공무원 중에서 지정하여야 한다.

② 국가기관의 장, 지방자치단체의 장 및 교육감(이하 "국가기관의 장등"이라 한다)은 건강안전책임관을 보좌하여 해당 기관의 재해예방 업무를 담당하는 건강안전담당관을 소속 공무원 중에서 지정할 수 있다.

③ 국가기관의 장등은 대통령령으로 정하는 바에 따라 해당 기관에 다음 각 호의 구분에 따른 사람(이하 "건강관리의등"이라 한다)을 각각 배치할 수 있다.

④ 국가기관의 장등은 건강관리의등의 업무를 대통령령으로 정하는 바에 따라 해당 업무를 전문적으로 수행할 수 있는 기관ㆍ법인 또는 단체나 개인에게 위탁할 수 있다.

⑤ 국가기관의 장등은 다음 각 호의 사항이 포함된 건강안전관리규정을 작성하여야 한다.

⑥ 그 밖에 건강안전책임관ㆍ건강안전담당관의 업무ㆍ자격ㆍ지정 및 건강안전관리규정의 작성에 필요한 사항은 대통령령으로 정한다.
