공무원임용시험령 제43조(5급 일반승진시험의 방법)

① 5급 일반승진시험은 제1차시험과 제2차시험을 구분하여 실시하되, 선택형(기입형을 포함할 수 있다) 또는 논문형(주관식 단답형을 포함할 수 있다. 이하 제2항에서 같다)으로 실시할 수 있다. 다만, 인사혁신처장이 필요하다고 인정할 때에는 제1차시험과 제2차시험을 병합하여 실시할 수 있으며, 면접시험이나 실기시험을 실시할 수 있다. <개정 2012.6.29, 2013.3.23, 2014.11.19>

② 소속 장관은 인사혁신처장에게 5급 일반승진시험의 제2차시험을 논문형으로 실시하도록 요구할 수 있다. 이 경우 시험요구일 1년 전에 요구하여야 한다. <개정 2012.6.29, 2013.3.23, 2014.11.19>

③ 제1차시험에 합격한 사람에 대해서는 본인이 응시요건을 갖추어 응시하는 다음 회 시험에서만 제1차시험을 면제한다.

⑤ 법 제28조제2항제2호 및 제10호와 이 영 제29조제1항에 따라 5급 공무원의 경력경쟁채용시험등 및 5등급 외무공무원의 경력경쟁채용시험등에서 필기시험이 면제되는 박사학위 및 자격증(또는 면허증) 소지자가 그 박사학위 및 자격증(또는 면허증)에 해당하는 직렬의 5급으로의 일반승진시험에 응시하는 경우에는 면접시험과 서류전형의 방법으로 시험을 실시할 수 있다. <개정 2011.11.1, 2014.10.8>
