공무원연금법 시행령 제72조(대여학자금부담금)

① 법 제75조에 따라 국가나 지방자치단체가 부담할 대여학자금부담금은 다음 각 호의 금액으로 한다.

② 인사혁신처장은 제1항에 따른 금액을 정하였을 때에는 그 부담금액을 관계 국가기관 및 지방자치단체에 통보하여야 하며, 통보를 받은 기관의 장은 해당 기관의 예산에 반영하고 그 금액을 공단에 내야 한다.

③ 법 제75조제3항에 따라 공무원연금기금에서 일시차입하는 경우 일시차입금의 이자는 차입기간 동안 해당 연도마다 1월 1일 현재 전국은행이 적용하는 정기예금금리 중 가장 높은 금리를 적용하여 산정한 금액으로 한다.

④ 국가나 지방자치단체가 법 제75조제2항 후단에 따른 더 내거나 덜 낸 대여학자금부담금을 다음 기의 납부 기한까지 정산하지 아니한 경우(다음 회계연도 1월 31일까지 전액을 공단에 납입하지 아니한 경우를 포함한다)에는 법 제75조제2항 후단에 따른 금액을 원금으로 하고 해당 연도마다 1월 1일 현재 전국은행이 적용하는 정기예금금리 중 가장 높은 금리를 적용하여 산정한 이자를 가산하여 정산하되, 회계연도마다 복리로 계산한다.

⑤ 공단은 국가 또는 지방자치단체가 낸 대여학자금부담금을 공무원연금기금으로부터의 차입금 보다 우선하여 공무원 본인 및 그 자녀에 대한 학자금으로 대여하여야 한다.

(5) The^ð더 Service서^v비스 shall섈 lend렌드 the^ð더 borrowed바^r로우드 tuition튜이션 fund^f펀드 contributions칸트^r러뷰션즈 paid페이드 by바이 the^ð더 State스테잇 or오 a어 local로우클 government거^v버먼트 as애즈 tuition튜이션 funds^f펀즈 for^f포 public퍼블릭 officials어^f피실즈 themselves^ð뎀셀^v브즈 and앤드 their^ð데어 children,칠드^r런 in인 priority프^r라이오^r러티 to투 borrowings바^r로잉즈 from^f프^r럼 the^ð더 Public퍼블릭 Officials어^f피실즈 Pension펜션 Fund.^f펀드

⑥ 대여학자금의 상환은 대여를 받은 공무원 본인 또는 그 자녀가 학교를 졸업한 후(자녀가 2년제 대학을 졸업하고 4년제 대학에 편입학한 경우에는 4년제 대학 졸업 후를 말한다) 2년 거치 4년 분할상환하되, 기여금징수의무자가 매월 보수에서 징수하여 공단에 내야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우의 거치기간 및 상환기간은 인사혁신처장이 정하는 바에 따른다. <개정 2025.7.7>

⑦ 대여학자금의 대여 대상ㆍ금액ㆍ시기 및 상환절차 등에 관하여 필요한 사항은 관계 기관과의 협의를 거쳐 인사혁신처장이 정한다.
