공무원연금법 시행령 제46조(연금액 전액 지급정지대상 출자ㆍ출연 기관의 지정 및 고시 등)

① 법 제50조제1항제3호부터 제5호까지의 규정에 따른 국가 또는 지방자치단체가 전액 출자ㆍ출연한 기관인지에 대한 판단은 결산기준 재무제표에 따른 최근 3년간 평균으로 산정한 국가 또는 지방자치단체의 출자ㆍ출연 비율을 기준으로 한다.

② 법 제50조제1항제3호부터 제5호까지의 규정에 따른 국가 또는 지방자치단체가 전액 출자ㆍ출연한 기관인지를 판단할 때 국가 또는 지방자치단체가 전액 출자ㆍ출연한 기관이 전액 출자ㆍ출연한 것은 국가 또는 지방자치단체가 전액 출자ㆍ출연한 것으로 본다.

③ 인사혁신처장은 법 제50조제1항제3호부터 제5호까지의 규정에 해당하는 기관인지를 파악하기 위하여 중앙행정기관의 장, 지방자치단체의 장 및 해당 출자ㆍ출연 기관의 장에게 관련 자료의 제출을 요청할 수 있다.

④ 제3항에 따라 자료제출을 요청받은 각 기관 또는 지방자치단체의 장은 특별한 사정이 없으면 요청에 따라야 한다.

⑤ 인사혁신처장은 법 제50조제1항제3호부터 제5호까지의 규정에 해당하는 기관을 지정하여 매년 1월 25일까지 관보에 고시하여야 한다.
