공동주택관리법 시행령 제4조(자치관리기구의 구성 및 운영)

① 법 제6조제1항에서 "대통령령으로 정하는 기술인력 및 장비"란 별표 1에 따른 기술인력 및 장비를 말한다.

② 법 제6조제1항에 따른 자치관리기구(이하 "자치관리기구"라 한다)는 입주자대표회의의 감독을 받는다.

③ 자치관리기구 관리사무소장은 입주자대표회의가 입주자대표회의 구성원(관리규약으로 정한 정원을 말하며, 해당 입주자대표회의 구성원의 3분의 2 이상이 선출되었을 때에는 그 선출된 인원을 말한다. 이하 같다) 과반수의 찬성으로 선임한다.

④ 입주자대표회의는 제3항에 따라 선임된 관리사무소장이 해임되거나 그 밖의 사유로 결원이 되었을 때에는 그 사유가 발생한 날부터 30일 이내에 새로운 관리사무소장을 선임하여야 한다.

⑤ 입주자대표회의 구성원은 자치관리기구의 직원을 겸할 수 없다.
