공공주택 특별법 시행규칙 제27조(공공임대주택의 중복입주 등의 확인 방법ㆍ절차 등)

① 공공주택사업자는 임차인(임대차계약 당사자를 말한다. 이하 이 조에서 같다)에 관한 법 제48조의3제2항 각 호의 사항(이하 이 조에서 "임차인 정보"라 한다)을 매분기마다 그 분기가 끝나는 달의 다음 달 15일까지 법 제48조의3제2항 각 호 외의 부분에 따른 전산관리지정기관(이하 이 조에서 "전산관리지정기관"이라 한다)에 통보하여야 한다. 이 경우 임차인 정보를 최초로 통보한 이후에는 새로 임대차계약을 체결하거나 임대차계약을 해지하는 등 임대차계약 사항에 변경이 있는 임차인에 관한 임차인 정보만을 통보할 수 있다.

② 제1항에 따른 통보를 받은 전산관리지정기관은 해당 분기가 끝나는 달의 다음 달 말일까지 임차인이 공공임대주택에 중복하여 입주 또는 계약하고 있는지 여부를 공공주택사업자에게 통보하여야 한다.

③ 제2항에 따라 통보를 받은 공공주택사업자는 그 사실을 해당 임차인에게 즉시 통보하고 10일 이상의 기간을 정하여 소명할 기회를 주어야 한다.
