공공단체등 위탁선거에 관한 법률 제58조(매수 및 이해유도죄)

1. 선거인[선거인명부를 작성하기 전에는 그 선거인명부에 오를 자격이 있는 자(해당 위탁단체에 가입되어 해당 법령이나 정관등에 따라 위탁선거의 선거권이 있는 자 및 해당 위탁단체에 가입 신청을 한 자를 말한다)를 포함한다. 이하 이 조에서 같다]이나 그 가족 또는 선거인이나 그 가족이 설립ㆍ운영하고 있는 기관ㆍ단체ㆍ시설에 대하여 금전ㆍ물품ㆍ향응이나 그 밖의 재산상 이익이나 공사(公私)의 직을 제공하거나 그 제공의 의사를 표시하거나 그 제공을 약속한 자

2. 후보자가 되지 아니하도록 하거나 후보자가 된 것을 사퇴하게 할 목적으로 후보자가 되려는 사람이나 후보자에게 제1호에 규정된 행위를 한 자

3. 위탁단체의 회원으로 가입하여 특정 후보자에게 투표하게 할 목적으로 위탁단체의 회원이 아닌 자에게 제1호에 규정된 행위를 한 자

4. 제1호부터 제3호까지에 규정된 이익이나 직을 제공받거나 그 제공의 의사표시를 승낙한 자

6. 후보자등록개시일부터 선거일까지 포장된 선물 또는 돈봉투 등 다수의 선거인(선거인의 가족 또는 선거인이나 그 가족이 설립ㆍ운영하고 있는 기관ㆍ단체ㆍ시설을 포함한다)에게 배부하도록 구분된 형태로 되어 있는 금품을 운반한 자
