공공단체등 위탁선거에 관한 법률 제11조(위탁선거의 관리)

① 중앙선거관리위원회는 이 법에 특별한 규정이 있는 경우를 제외하고는 위탁선거 사무를 통할ㆍ관리하며, 하급선거관리위원회의 위법ㆍ부당한 처분에 대하여 이를 취소하거나 변경할 수 있다.

② 특별시ㆍ광역시ㆍ도ㆍ특별자치도선거관리위원회는 하급선거관리위원회의 위탁선거에 관한 위법ㆍ부당한 처분에 대하여 이를 취소하거나 변경할 수 있다.

③ 관할위원회는 선거관리를 위하여 필요하다고 인정하는 경우에는 중앙선거관리위원회규칙으로 정하는 바에 따라 관할위원회가 지정하는 사람 또는 하급선거관리위원회나 다른 구ㆍ시ㆍ군선거관리위원회로 하여금 위탁선거 사무를 행하게 할 수 있다.

④ 직근 상급선거관리위원회는 관할위원회가 천재지변, 그 밖의 부득이한 사유로 그 기능을 수행할 수 없는 경우에는 위탁선거 사무를 직접 관리하거나 다른 선거관리위원회로 하여금 관할위원회의 기능이 회복될 때까지 대행하게 할 수 있다. 이 경우 다른 선거관리위원회로 하여금 위탁선거 사무를 대행하게 하는 때에는 대행할 업무의 범위도 함께 정하여야 한다.

⑤ 직근 상급선거관리위원회는 제4항에 따라 위탁선거 사무를 직접 관리하거나 대행하게 한 경우에는 해당 선거관리위원회와 업무의 범위를 지체 없이 공고하여야 한다.
