공간정보의 구축 및 관리 등에 관한 법률 제52조의2(측량업자의 행정처분 효과의 승계 등)

① 제48조에 따라 폐업신고한 측량업자가 폐업신고 당시와 동일한 측량업을 다시 등록한 때에는 폐업신고 전의 측량업자의 지위를 승계한다.

② 제1항의 경우 폐업신고 전의 측량업자에 대하여 제52조제1항 및 제111조제1항부터 제3항까지의 규정의 위반행위로 인한 행정처분의 효과는 그 폐업일부터 6개월 이내에 다시 측량업의 등록을 한 자(이하 이 조에서 "재등록 측량업자"라 한다)에게 승계된다. <개정 2022.11.15>

③ 제1항의 경우 재등록 측량업자에 대하여 폐업신고 전의 제52조제1항 각 호의 위반행위에 대한 행정처분을 할 수 있다. 다만, 다음 각 호의 어느 하나에 해당하는 경우는 제외한다.

④ 제3항에 따라 행정처분을 할 때에는 폐업기간과 폐업의 사유를 고려하여야 한다.
