공간정보의 구축 및 관리 등에 관한 법률 시행규칙 제59조(토지의 조사ㆍ등록)

① 지적소관청은 법 제64조제2항 단서에 따라 토지의 이동현황을 직권으로 조사ㆍ측량하여 토지의 지번ㆍ지목ㆍ면적ㆍ경계 또는 좌표를 결정하려는 때에는 토지이동현황 조사계획을 수립하여야 한다. 이 경우 토지이동현황 조사계획은 시ㆍ군ㆍ구별로 수립하되, 부득이한 사유가 있는 때에는 읍ㆍ면ㆍ동별로 수립할 수 있다.

② 지적소관청은 제1항에 따른 토지이동현황 조사계획에 따라 토지의 이동현황을 조사한 때에는 별지 제55호서식의 토지이동 조사부에 토지의 이동현황을 적어야 한다.

③ 지적소관청은 제2항에 따른 토지이동현황 조사 결과에 따라 토지의 지번ㆍ지목ㆍ면적ㆍ경계 또는 좌표를 결정한 때에는 이에 따라 지적공부를 정리하여야 한다.

④ 지적소관청은 제3항에 따라 지적공부를 정리하려는 때에는 제2항에 따른 토지이동 조사부를 근거로 별지 제56호서식의 토지이동 조서를 작성하여 별지 제57호서식의 토지이동정리 결의서에 첨부하여야 하며, 토지이동조서의 아래 부분 여백에 "「공간정보의 구축 및 관리 등에 관한 법률」 제64조제2항 단서에 따른 직권정리"라고 적어야 한다. <개정 2017.1.31>
