골재채취법 제17조(골재채취업의 양도)

① 골재채취업자가 골재채취업을 양도하거나 합병하려는 경우(골재채취업자인 법인이 골재채취업자가 아닌 법인을 흡수합병하는 경우는 제외한다)에는 대통령령으로 정하는 바에 따라 시장ㆍ군수 또는 구청장에게 신고하여야 한다.

(1) Where웨어 an앤 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 operator아퍼^r레이터 intends인텐즈 to투 transfer트^r랜스^f퍼 or오 merge머지 the^ð디 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 (excluding익스클루딩 cases케이시즈 where웨어 a어 corporation코퍼^r레이션 that^ð댓 is이즈 an앤 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 operator아퍼^r레이터 absorbs어브조브즈 a어 corporation코퍼^r레이션 that^ð댓 is이즈 not낫 an앤 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 operator),아퍼^r레이터 the^ð디 operator아퍼^r레이터 shall섈 report^r리포트 it잇 to투 the^ð더 head헤드 of어^v브 a어 Si/Gun시 or오 Gu,구 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

② 제1항에 따른 신고를 한 경우의 양수인 및 합병으로 설립되거나 존속(存續)하는 법인은 각각 양도인 및 합병 전 법인의 골재채취업자로서의 지위를 승계한다.

(2) Where웨어 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1) has해즈 been빈 made,메이드 the^ð더 transferee,트^r랜스^f퍼^r리 and앤드 the^ð더 corporation코퍼^r레이션 established이스태블리시트 or오 surviving서^v바이^v빙 through^θ쓰^r루 the^ð더 merger,머저 shall섈 succeed석시드 to투 the^ð더 status스태터스 of어^v브 the^ð더 transferor트^r랜스^f퍼^r러 and앤드 of어^v브 the^ð더 pre-merger프^r리-머저 corporation,코퍼^r레이션 respectively,^r리스펙티^v블리 as애즈 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 operator.아퍼^r레이터

③ 골재채취업자가 사망한 경우 그 상속인이 골재채취업자의 지위를 승계하여 골재채취업을 경영하려면 상속일부터 3개월 이내에 그 상속 사실을 시장ㆍ군수 또는 구청장에게 신고하여야 한다.

(3) Where웨어 an앤 aggregate애그^r러것 extraction엑스트^r랙션 business비즈니스 operator아퍼^r레이터 dies,다이즈 and앤드 the^ð디 heir에어 intends인텐즈 to투 succeed석시드 to투 the^ð더 status스태터스 of어^v브 the^ð디 operator아퍼^r레이터 and앤드 operate아퍼^r레잇 the^ð디 aggregate애그^r러것 extraction엑스트^r랙션 business,비즈니스 the^ð디 heir에어 shall섈 report^r리포트 the^ð더 succession석세션 to투 the^ð더 head헤드 of어^v브 a어 Si/Gun시 or오 Gu구 within위^ð딘 three^θ쓰^r리 months먼^θ쓰 of어^v브 the^ð더 date데잇 of어^v브 succession.석세션

④ 시장ㆍ군수 또는 구청장은 제1항 또는 제3항에 따른 신고를 받은 날부터 7일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2020.6.9>

(4) The^ð더 head헤드 of어^v브 a어 Si/Gun시 or오 Gu구 shall섈 notify노우터^f파이 the^ð더 person퍼슨 making메이킹 the^ð더 report^r리포트 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 within위^ð딘 seven세^v븐 days데이즈 of어^v브 receiving^r러시^v빙 the^ð더 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1) or오 (3).

⑤ 시장ㆍ군수 또는 구청장이 제4항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2020.6.9>

(5) Where웨어 the^ð더 head헤드 of어^v브 a어 Si/Gun시 or오 Gu구 fails^f페일즈 to투 notify노우터^f파이 the^ð더 person퍼슨 making메이킹 the^ð더 report^r리포트 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted,액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 the^ð더 relevant^r렐러^v번트 statutes스태춧츠 on안 the^ð더 handling핸들링 of어^v브 civil시^v블 petitions,퍼티션즈 within위^ð딘 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (4), the^ð더 report^r리포트 shall섈 be비 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 following^f팔로잉 the^ð디 expiration엑스퍼^r레이션 of어^v브 that^ð댓 period.피^r리어드
