곤충산업의 육성 및 지원에 관한 법률 시행령 제5조의2(손실보상)

① 법 제10조제2항에 따른 곤충의 사육 및 유통의 제한 또는 폐기 명령으로 인하여 손실을 받은 자가 보상을 받으려는 경우에는 그 명령에 따른 조치의 이행이 완료된 날부터 3개월 이내에 손실보상청구서에 농림축산식품부령으로 정하는 서류를 첨부하여 해당 사업장의 소재지를 관할하는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

② 제1항에 따라 손실보상청구서를 제출받은 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 손실보상청구서를 제출받은 날부터 30일 이내에 조치의 이행 여부 및 손실보상청구의 적정성 등을 검토한 의견서를 첨부하여 농림축산식품부장관에게 제출하여야 한다.

③ 제2항에 따라 손실보상청구서와 의견서를 제출받은 농림축산식품부장관은 그 제출받은 날부터 60일 이내에 손실보상금을 결정하여 손실보상을 청구한 자에게 지급하여야 한다. 다만, 그 기간 안에 손실보상금을 결정하여 지급하기 어려운 경우에는 손실보상을 청구한 자에게 그 사유를 통지하고 1회에 한정하여 30일의 범위에서 그 기간을 연장할 수 있다.

④ 법 제10조제3항에 따른 손실보상금은 별표 1의 산정기준에 따라 산정하여 지급한다. 다만, 국가 또는 지방자치단체 소유의 곤충은 손실보상의 대상에서 제외한다.

⑤ 농림축산식품부장관은 손실보상금의 산정을 위하여 필요한 경우에는 손실보상을 청구한 자 및 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 증빙ㆍ보완 자료의 제출을 요구할 수 있으며, 「감정평가 및 감정평가사에 관한 법률」에 따른 감정평가사 등 전문기관에 손실보상금의 산정을 의뢰할 수 있다. <개정 2016.8.31>

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 손실보상금의 지급에 필요한 사항은 농림축산식품부장관이 정하여 고시한다.
