고위공직자범죄수사처 설치 및 운영에 관한 법률 제39조(퇴직 희망 수사처검사의 징계사유 확인 등)

① 처장은 수사처검사가 퇴직을 희망하는 경우에는 제32조에 따른 징계사유가 있는지 여부를 감사원, 공소청(광역공소청, 지방공소청 및 지방공소청 지청을 포함한다), 중대범죄수사청 및 경찰, 그 밖의 수사기관에 확인하여야 한다. <개정 2026.9.29>

② 제1항에 따른 확인 결과 해임, 면직 또는 정직에 해당하는 징계 사유가 있는 경우 처장은 지체 없이 징계등을 청구하여야 하며, 징계위원회는 다른 징계사건에 우선하여 징계등을 의결하여야 한다.
