고위공무원단 인사규정 제21조(고위공무원의 강임)

① 소속 장관은 고위공무원을 제5장의 적격심사를 회피할 목적으로 강임해서는 아니 되며, 고위공무원을 강임할 때에는 3급 공무원으로 임용하여 고위공무원단 직위가 아닌 직위에 임명하여야 한다.

② 고위공무원에서 강임된 사람(본인의 동의에 따라 강임된 사람은 제외한다)을 고위공무원단 직위로 승진임용하려는 때에는 강임된 사람이 2명 이상인 경우의 우선임용 순위는 강임날짜 순으로 하되, 강임날짜가 같은 경우에는 종전 고위공무원단 직위로 승진임용된 날짜의 순서에 따른다.

③ 법 제73조의4제2항 단서에 따라 본인의 동의에 따라 강임된 공무원을 우선 승진임용하는 경우에는 본인의 경력과 해당 기관의 인력 사정을 고려하여 다른 승진 예정 공무원과 균형을 유지하도록 하여야 한다. 이 경우 강임된 사람이 2명 이상일 경우의 승진임용에 관하여는 제2항을 준용한다.
