고위공무원단 인사규정 제13조(일반직 고위공무원의 경력경쟁채용등의 요건)

1. 법 제28조제2항제1호에 따라 고위공무원단 직위 또는 그에 상응하는 직위에 재직하였던 일반직 고위공무원(임기제공무원은 제외한다. 이하 이 호, 제4호 및 제5호에서 같다)을 재임용하는 경우에는 이전 재직기관에 전력(前歷)을 조회하여 그 퇴직 사유가 확인된 사람이어야 하며, 같은 호에 따라 특수경력직공무원이나 다른 종류의 경력직공무원이 되기 위하여 퇴직하였던 일반직 고위공무원을 재임용하는 경우에는 퇴직 후 30일이 지나지 않아야 한다. 이 경우 전력 조회에 관하여는 「공무원 인사기록ㆍ통계 및 인사사무 처리 규정」에서 정하는 바에 따른다.

2. 법 제28조제2항제2호에 따라 같은 종류의 직무에 관한 자격증 소지자를 경력경쟁채용등을 하는 경우에는 「공무원임용시험령」(이하 "시험령"이라 한다) 제27조제1항에 따른 임용예정 직급별 자격증 중 임용예정 직위의 직무 내용과 관련된 자격증을 가진 사람으로서 시험령 별표 7 및 별표 8에 규정된 3급 경력기준에 해당하는 사람이어야 한다.

3. 법 제28조제2항제3호에 따라 경력경쟁채용등을 하는 경우에는 다음 각 목의 어느 하나에 해당하는 사람으로서 시험요구일 현재 퇴직 후 3년이 지나지 않아야 한다. 다만, 라목의 경우에는 시험 요구일 현재 재직 중이어야 한다.

5. 법 제28조제2항제7호에 따라 지방공무원을 일반직 고위공무원으로 경력경쟁채용등을 하는 경우에는 고위공무원단 직위에 상응하는 지방자치단체 또는 지방교육행정기관의 직위에서 일반직공무원(임기제공무원은 제외한다)으로 근무한 경력이 있는 사람이어야 한다.

6. 법 제28조제2항제10호에 따라 임용예정 직위와 관련되는 과학기술 분야 또는 통계, 전자계산, 대외통상, 환경, 교통, 도시공학 분야, 그 밖에 소속 장관이 공개경쟁채용시험에 의한 결원 보충이 곤란하다고 인정하여 정하는 특수 전문 분야에서 근무하거나 연구한 경력이 있는 사람을 경력경쟁채용등을 하는 경우에는 박사학위소지자로서 임용령 별표 4의 3급 경력기준에 해당하는 사람이어야 한다.
