고용보험법 시행규칙 제85조(직업능력개발 훈련 등 수강자에 대한 실업인정의 특례)

① 법 제44조제2항제1호에 따른 직업능력개발 훈련 등을 받는 수급자격자(직업능력개발 훈련 등의 기간이 28일 미만인 사람은 제외한다)에 대한 실업은 그 훈련기관을 관할하는 직업안정기관의 장(이하 "훈련기관 관할 직업안정기관의 장"이라 한다)이 월 1회 지정한 날에 그 이전 1개월간의 각각의 날(이미 실업인정의 대상이된 날은 제외한다)에 대하여 인정한다. <개정 2021.7.1>

② 훈련기관 관할 직업안정기관의 장은 직업능력개발 훈련 등의 대상자로 선발된 수급자격자에게 실업을 인정받아야 할 날(이하 "실업인정일"이라 한다)을 정하여 알려야 한다.

③ 제1항과 제2항에도 불구하고 직업능력개발 훈련 등의 기간에 대한 마지막 실업인정일이 그 훈련의 종료일과 다른 경우에는 그 훈련의 종료일을 실업인정일로 정하여 알릴 수 있다. 이 경우 훈련기관 관할 직업안정기관의 장은 직전 실업인정일 다음 날부터 훈련종료일까지의 각각의 날에 대하여 실업을 인정하여야 한다.

④ 직업능력개발 훈련 등을 받는 수급자격자가 실업을 인정받으려면 별지 제82호서식의 실업인정신청서에 수급자격증과 직업능력개발 훈련 등의 실시기관이 발급하는 별지 제83호서식의 직업능력개발 훈련 등 수강증명서(이하 "수강증명서"라 한다)를 첨부하여 훈련기관 관할 직업안정기관의 장에게 제출해야 한다. <개정 2021.7.1>

⑤ 훈련기관 관할 직업안정기관의 장은 직업능력개발 훈련 등을 받는 수급자격자가 직업능력개발 훈련 등으로 인하여 직업안정기관에 출석하는 것이 적당하지 아니하다고 인정되면 그 대리인으로 하여금 제4항에 따른 서류를 제출하게 할 수 있다.
