경찰공무원 징계령 제5조(관련 사건의 관할)

① 상위 계급과 하위 계급의 경찰공무원이 관련된 징계등 사건은 제4조에도 불구하고 상위 계급의 경찰공무원을 관할하는 징계위원회에서 심의ㆍ의결하고, 상급 경찰기관과 하급 경찰기관에 소속된 경찰공무원이 관련된 징계등 사건은 상급 경찰기관에 설치된 징계위원회에서 심의ㆍ의결한다. 다만, 상위 계급의 경찰공무원이 감독상 과실책임만으로 관련된 경우에는 제4조에 따른 관할 징계위원회에서 각각 심의ㆍ의결할 수 있다.

② 소속이 다른 2명 이상의 경찰공무원이 관련된 징계등 사건으로서 관할 징계위원회가 서로 다른 경우에는 모두를 관할하는 바로 위 상급 경찰기관에 설치된 징계위원회에서 심의ㆍ의결한다.

③ 「경찰공무원법」 제37조제1항 또는 제2항에 따른 위반행위와 관련된 징계등 사건은 제4조제2항에도 불구하고 경찰청ㆍ해양경찰청ㆍ시ㆍ도경찰청 또는 지방해양경찰청에 설치된 보통징계위원회에서 심의ㆍ의결할 수 있다. <개정 2014.11.19, 2017.7.26, 2020.12.31>

④ 제1항과 제2항에 따른 관할 징계위원회는 제1항과 제2항에도 불구하고 관련자에 대한 징계등 사건을 분리하여 심의ㆍ의결하는 것이 타당하다고 인정되는 경우에는 해당 징계위원회의 의결로 관련자에 대한 징계등 사건을 제4조에 따른 관할 징계위원회로 이송할 수 있다.
