경찰공무원 교육훈련규정 제26조(복무의무 위반에 대한 소요경비의 반납조치)

① 임용권자는 법 제10조제2항제2호에 따라 경찰공무원으로 임용된 사람이 다음 각 호의 어느 하나에 해당하게 된 경우에는 그 대상자의 교육훈련에 든 경비(학비, 기숙사비, 수당, 지급 물품비, 급식비, 그 밖에 해당 경찰공무원의 교육에 소요된 모든 비용을 말한다)의 전부 또는 일부를 본인이나 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)으로 하여금 반납하게 해야 한다. 이 경우 교육훈련에 든 경비의 산정 방법 및 금액 등에 관한 세부 사항은 경찰청장이 정한다.

③ 임용권자는 법 제10조제2항제2호에 따라 경찰공무원으로 임용된 사람이 의무복무기간 중에 퇴직하기를 원하는 경우에는 면직 결정 전에 제1항 및 제2항에 따른 소요경비를 반납받기 위한 조치를 해야 한다. 이 경우 교육훈련비 지급기관과 면직 결정기관이 서로 다를 때에는 면직 결정기관의 장은 면직 결정 전에 교육훈련비 지급기관의 장과 면직 결정 여부 및 시기 등을 협의해야 한다.
