건축물의 분양에 관한 법률 시행령 제12조(공표 방법 및 절차 등)

① 허가권자는 법 제9조제1항에 따라 분양사업자에게 위반행위의 시정을 명할 때에는 위반행위의 내용 및 정도, 기간 및 횟수, 매체 및 광고의 크기 등을 고려하여야 한다.

② 허가권자가 제1항에 따라 위반행위의 시정을 명할 때에는 해당 분양사업자에게 미리 공표 문안 등에 관하여 허가권자와 협의하게 할 수 있다.

③ 시정명령을 받은 분양사업자는 시정명령을 받은 날부터 10일 이내에 시정명령을 받은 내용과 정정사항 등을 위반행위가 이루어진 해당 간행물ㆍ분양사업장 또는 전자매체에 공표하여야 한다.

④ 제3항에 따른 공표는 평일(토요일과 「관공서의 공휴일에 관한 규정」 제2조에 따른 공휴일을 제외한 날을 말한다)에 게재하도록 하고, 공표 제목에는 시정명령을 받은 사실을 명료하게 표시하여야 하며, 위반행위가 이루어진 분양 광고 크기의 4분의 1 이상으로 공표하여야 한다.

⑤ 허가권자는 시정명령을 받은 분양사업자가 제3항에 따라 공표한 날부터 10일 이내에 그 명령을 이행하였는지를 확인하여야 한다.
