건설산업기본법 제13조(건설업 등록의 결격사유)
Framework Act on the Construction Industry, Article 13 (Grounds for Disqualification from Registration of Construction Businesses)
① 다음 각 호의 어느 하나에 해당하는 자(법인인 경우 다음 각 호의 어느 하나에 해당하는 사람이 임원으로 있는 경우를 포함한다)는 제9조제1항에 따른 건설업 등록을 할 수 없다. 외국인이나 외국법인이 해당 국가에서 다음 각 호의 어느 하나에 해당하는 사유와 같거나 유사한 사유에 해당하는 경우에도 같다. <개정 2011.5.24, 2012.6.1, 2014.5.14, 2017.3.21>
(1) A person who falls under any of the following subparagraphs (or, in the case of a corporation, a corporation that has as an officer a person who falls under any of the following subparagraphs) may not register a construction business under Article 9 (1). The same shall apply where a foreigner or a foreign corporation falls under grounds in the relevant country that are the same as or similar to those in any of the following subparagraphs:
1. 파산선고를 받고 복권되지 아니한 자
1. A person who has been declared bankrupt and has not been reinstated;
2. 피성년후견인 또는 피한정후견인
2. A person under adult guardianship or limited guardianship;
3.제82조의2 또는 제83조에 따라 건설업의 등록이 말소된 자로서 다음 각 목의 어느 하나에 해당하는 자. 이 경우 건설업 등록이 말소된 자가 법인인 경우에는 말소 당시의 원인이 된 행위를 한 사람과 대표자를 포함한다.
3. A person whose construction business registration was cancelled under Article 82-2 or 83, who falls under any of the following items. In such cases, where the person whose construction business registration was cancelled is a corporation, this includes the person who committed the act that caused the cancellation at the time and its representative:
가. 제83조제5호에 해당하는 사유로 건설업의 등록이 말소된 후 10년이 지나지 아니한 자
(a) A person for whom 10 years have not passed since the registration of the construction business was cancelled on the ground of subparagraph 5 of Article 83;
나. 제82조의2제3항, 제83조제1호ㆍ제3호의3ㆍ제8호ㆍ제10호 및 제13호에 해당하는 사유로 건설업의 등록이 말소된 후 5년이 지나지 아니한 자
(b) A person for whom five years have not passed since the registration of the construction business was cancelled on the grounds of Article 82-2 (3), or subparagraph 1, 3-3, 8, 10 or 13 of Article 83;

라. 제82조의2제3항, 제83조제1호ㆍ제3호의3ㆍ제4호ㆍ제5호ㆍ제8호ㆍ제10호 및 제13호 외의 사유로 건설업의 등록이 말소된 후 1년 6개월이 지나지 아니한 자
(d) A person for whom one year and six months have not passed since the registration of the construction business was cancelled on grounds other than those of Article 82-2 (3), or subparagraph 1, 3-3, 4, 5, 8, 10 or 13 of Article 83;
4. 이 법 또는 「주택법」을 위반하여 금고 이상의 실형을 선고받고 그 집행이 종료(집행이 종료된 것으로 보는 경우를 포함한다)되거나 그 집행이 면제된 날부터 3년이 지나지 아니한 자
4. A person who was sentenced to imprisonment without labor or a heavier punishment for violating this Act or the Housing Act, and for whom three years have not passed since the date the execution of the sentence was completed (including where it is deemed completed) or exempted;
5. 「형법」 제129조부터 제133조까지의 죄 중 어느 하나에 해당하는 죄를 범하여 금고 이상의 실형을 선고받고 그 집행이 종료(집행이 종료된 것으로 보는 경우를 포함한다)되거나 집행이 면제된 날부터 5년이 지나지 아니한 자
5. A person who was sentenced to imprisonment without labor or a heavier punishment for committing any of the crimes under Articles 129 through 133 of the Criminal Act, and for whom five years have not passed since the date the execution of the sentence was completed (including where it is deemed completed) or exempted;
6. 제4호 또는 제5호의 죄를 범하여 형의 집행유예를 선고받고 그 유예기간 중에 있는 자
6. A person who was sentenced to a suspended sentence for committing a crime under subparagraph 4 or 5 and is still in the period of suspension.

③ 국토교통부장관은 제9조제2항에 따라 등록을 신청한 자 중에서 제1항에 따라 건설업 등록을 할 수 없는 자에게 그 사유를 알려야 한다. <개정 2011.5.24, 2013.3.23>
(3) The Minister of Land, Infrastructure and Transport shall notify any applicant for registration under Article 9 (2) who may not register a construction business under paragraph (1) of the reasons.
