건설기계관리법 제34조의2(건설기계의 강제처리 등)

① 시장ㆍ군수ㆍ구청장은 건설기계의 소유자 또는 점유자가 제33조제3항에 따른 금지행위를 한 경우에는 국토교통부령으로 정하는 바에 따라 건설기계의 폐기 요청 또는 그 밖의 처분 등을 하거나 해당 건설기계를 찾아가는 등 적절한 조치를 할 것을 본인에게 명할 수 있다. <개정 2013.3.23, 2026.2.27>

② 시장ㆍ군수ㆍ구청장은 건설기계의 소유자 또는 점유자가 제1항에 따른 명령을 받은 날부터 1개월이 지날 때까지 이를 이행하지 아니한 경우에는 대통령령으로 정하는 바에 따라 건설기계를 매각하거나 폐기할 수 있다. <개정 2026.2.27>

③ 시장ㆍ군수ㆍ구청장은 제33조제3항에 따른 금지행위를 한 경우로서 그 건설기계의 소유자 또는 점유자를 알 수 없으면 공고기간이 끝난 후 대통령령으로 정하는 바에 따라 그 건설기계를 매각하거나 폐기할 수 있다. 이 경우 시장ㆍ군수ㆍ구청장은 7일 이상의 기간을 정하여 해당 건설기계에 대한 처분의 내용 등 대통령령으로 정하는 사항을 미리 공고하여야 한다. <개정 2026.2.27>

④ 제2항 및 제3항에 따라 건설기계를 매각하거나 폐기한 경우 매각 또는 폐기에 드는 비용은 그 건설기계의 소유자 또는 점유자의 부담으로 하되, 시장ㆍ군수ㆍ구청장은 매각 또는 폐기에서 생긴 수익으로 비용을 우선 충당하여야 하고, 충당하고도 남은 금액이 있을 때에는 그 건설기계의 소유자 또는 점유자에게 지급하여야 하며, 건설기계의 소유자 또는 점유자를 알 수 없을 때에는 「공탁법」에 따라 공탁하여야 한다. <개정 2026.2.27>
