건설기계관리법 제25조의2(건설기계의 해체재활용)

① 건설기계해체재활용업자는 건설기계 소유자 또는 시ㆍ도지사로부터 폐기의 요청을 받은 경우에는 해당 건설기계와 등록번호표를 인수하고 그 사실을 증명하는 서류를 발급하여야 한다.

② 건설기계해체재활용업자는 제1항에 따라 건설기계와 등록번호표를 인수하면 해당 건설기계를 폐기한 후 등록번호표를 절단하여 폐기하여야 한다. 다만, 제1항에 따라 인수한 건설기계를 건설기계해체재활용업자가 「관세법」에 따라 수출신고를 하고 수출하거나 수출업자에게 판매하는 경우에는 폐기하지 아니할 수 있다.

③ 제2항 단서에 따라 해당 건설기계를 수출하려는 자는 수출 전까지 등록을 말소한 시ㆍ도지사에게 등록말소사유 변경을 신고하여야 한다.

⑤ 건설기계해체재활용업자는 국토교통부령으로 정하는 바에 따라 폐기하려는 건설기계의 평가액에서 폐기에 드는 비용을 뺀 나머지 금액을 그 건설기계의 소유자에게 지급하여야 한다. 다만, 폐기에 드는 비용이 폐기하려는 건설기계의 평가액을 초과하는 경우에는 국토교통부령으로 정하는 바에 따라 그 초과비용을 건설기계의 소유자로부터 받을 수 있다.
