건강기능식품에 관한 법률 시행령 제6조의2(소비자등의 위생검사등 요청 요건 및 절차 등)

① 법 제20조의2제1항 각 호 외의 부분 본문에서 "대통령령으로 정하는 그 소속 기관의 장"이란 지방식품의약품안전청장을 말하고, "대통령령으로 정하는 일정 수 이상의 소비자"란 같은 품목에 의하여 같은 피해를 입은 20명 이상의 소비자를 말한다.

② 법 제20조의2제1항에 따라 법 제20조에 따른 출입ㆍ검사ㆍ수거 등(이하 이 조에서 "위생검사등"이라 한다)을 요청하려는 자는 총리령으로 정하는 요청서를 식품의약품안전처장(지방식품의약품안전청장을 포함한다. 이하 이 조에서 같다) 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장(자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)에게 제출하여야 한다. 이 경우 요청하려는 자가 소비자인 경우에는 그 대표자가, 소비자단체(법 제20조의2제1항에 따른 소비자단체를 말한다. 이하 이 조에서 같다) 또는 시험ㆍ검사기관(법 제20조의2제1항에 따른 시험ㆍ검사기관을 말한다. 이하 이 조에서 같다)인 경우에는 그 소비자단체의 장 또는 시험ㆍ검사기관의 장이 요청서를 제출하여야 한다.

③ 식품의약품안전처장 또는 시장ㆍ군수ㆍ구청장은 법 제20조의2제2항에 따라 위생검사등의 결과를 알리는 경우에는 소비자의 대표자, 소비자단체의 장 또는 시험ㆍ검사기관의 장이 요청하는 방법으로 하되, 따로 정하지 아니한 경우에는 문서로 한다.
