Enforcement Decree of the Act on Sustainable Management and Restoration of Tidal Flats and Surrounding Areas, Article 10 (Exceptions to Restrictions on Acts)
① 법 제16조제2항제2호에서 "대통령령으로 정하는 재해"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(1) "Disasters prescribed by Presidential Decree" in Article 16 (2) 2 of the Act means any of the following cases:
1. 건축물ㆍ공작물의 붕괴 및 폭발 등으로 인명 피해가 발생하거나 재산적 손실이 발생한 경우
1. Where casualties or property loss occur due to collapse or explosion, etc. of a building or structure; and
2. 그 밖에 현존하는 위험으로부터 인명을 긴급히 구조할 필요가 있는 경우
2. Other cases where it is necessary to urgently rescue human lives from an existing danger.
② 법 제16조제2항제3호에서 "대통령령으로 정하는 경우"란 관리구역이나 관리구역에 영향을 미칠 수 있는 인접지역에 거주하는 주민, 관리구역 안의 토지 및 공유수면의 소유자ㆍ점유자 또는 관리인의 행위로서 생태적으로 지속가능하다고 인정되는 수산물의 포획ㆍ채취 또는 양식, 수산종자의 생산 및 소금 제조 등의 행위를 하기 위해 필요한 경우를 말한다.
(2) "Cases prescribed by Presidential Decree" in Article 16 (2) 3 of the Act means cases necessary for acts such as capturing, collecting, or farming fishery products, producing fishery seedlings, and manufacturing salt that are recognized as ecologically sustainable, by residents living in a management zone or an adjacent area that may affect a management zone, or by owners, occupants, or managers of land and public waters in a management zone.
③ 법 제16조제2항제6호에서 "대통령령으로 정하는 행위를 하거나 필요한 시설을 설치하는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(3) "Cases of performing acts or installing necessary facilities prescribed by Presidential Decree" in Article 16 (2) 6 of the Act means any of the following cases:
1. 법 제11조의 관리구역 관리계획(이하 "관리계획"이라 한다)에 따라 시설을 설치하는 경우
1. Where facilities are installed according to the management zone management plan under Article 11 of the Act (hereinafter referred to as the "management plan");
2. 관리구역의 갯벌생태계에 대한 정기적인 현황조사와 관측 및 연구 활동을 하는 경우
2. Where periodic status surveys, observation, and research activities are conducted on the tidal flat ecosystem in a management zone; and
3. 관리구역을 보호하고 갯벌생태계의 훼손을 방지하기 위한 시설을 설치하는 경우
3. Where facilities are installed to protect a management zone and prevent damage to the tidal flat ecosystem.
