Regulations on the Operation of Open Positions and Public Recruitment Positions, Article 20 (Restrictions on Appointment of Persons Appointed to Public Recruitment Positions to Other Positions, etc.)

① 공모 직위에 임용된 공무원은 「공무원임용령」 제45조에도 불구하고 임용된 날부터 2년 이내에 다른 직위에 임용될 수 없다. 다만, 다음 각 호의 어느 하나에 해당하는 경우는 예외로 한다. <개정 2013.3.23, 2013.10.16, 2014.11.19>

1. 소속 장관이 제15조, 제17조 및 제18조에 따른 절차와 방법에 따라 공모 직위에 임용된 사람을 제1항 각 호 외의 부분 단서에 따라 다른 직위에 임용하는 경우

③ 제2항에 따라 공모 직위에 임용된 사람을 다른 직위에 임용할 때 임용을 위한 결원이 없는 경우에는 최초로 결원이 발생할 때까지 정원이 따로 있는 것으로 보고 임용할 수 있다. 다만, 해당 기관 내에서 전보하는 경우에는 정원이 따로 있는 것으로 보지 아니한다.
